Terms of Use

1. To qualify for a Referral Reward, the referred person must:

I. be a new customer,
II. provide the discount code of the Host at time of purchase,
III. make a purchase on www.merkava.ca

Hosts will receive a Referral Reward of $50 via e-transfer after the referral is confirmed and the referral credit is approved by a customer service member. Referring customers may only earn one (1) referral credit per referred person. In the event a referred person returns a purchased product and their lifetime order value decreases below the minimum purchase amount, the referral credit awarded to the referring customer will be rescinded. Customers may not refer anyone who has an existing www.merkava.ca account under an alternate email address.

Any abuse of this offer, as determined by us in our sole discretion, may result in the rescission of the Host’s referral credit and their ability to participate in this or future programs. The Host program is subject to modification or termination at any time without notice in our sole discretion.

2. How the Merkava Services Work

We sell Merkava eBikes (“Merchandise”) through our website. Because we only have one retail showroom that we own and operate (Laval, QC), we have created a platform where potential customers can see our eBikes in the neighbourhoods where our customers have purchased such Merchandise. Our Services may be used to facilitate the reserving of Host appointments (“Host Appointments”) between users who have purchased Merchandise and wish to use their home (“Property”) to show such Merchandise (“Hosts”) and users who would like to schedule a time to view and evaluate such Merchandise at the Host’s Property or neighborhood (“Guest”). The Hosts and Guests make arrangements for Appointments directly with each other through the email exchange. If a Guest is interested in purchasing Merchandise, the Guest may also do so through the Merkava website. Merkava is not an owner or operator of any of the Properties. Our responsibilities are limited to facilitating the availability of the Services as described herein.

Hosts are not employees, partners, representatives, agents, joint venturers, or franchisees of Merkava. Merkava does not perform any obligations in connection with showroom appointments and does not employ hosts to perform such obligations. Users hereby acknowledge that Merkava does not supervise, direct, control or monitor a Host’s appointments. The relationship between hosts and Merkava is that of an independent contractor. Merkava is thereby not responsible for theft or damage to the Merchandise nor for injuries that may incur.

3. Release of Liability

Please note that, as stated above, the services are intended to be used to facilitate hosts and guests directly with each other. Merkava cannot and does not control the condition, legality, safety, or suitability of any hosts, guests, properties or merchandise. Merkava is not responsible for and disclaims any and all liability related to any and all Host appointments, properties and merchandise. Accordingly, any showroom appointments will be made or accepted at a user’s own risk.

4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Merkava, its affiliates, employees, licensors or service providers be liable for any indirect, consequential, exemplary, incidental, special, punitive, or enhanced damages, including, without limitation, loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (I) your access to or use of or inability to access or use the service, (II) the conduct or content of other users or third parties on, through, or following use of the service; or (III) unauthorized access, use or alteration of your content, even if Merkava has been advised of the possibility of such damages.

5. Safety; Your Interactions with Other Customers

Merkava is not responsible for the conduct of any user on or off of the Service. You agree to use caution in all interactions with users, particularly if you decide to communicate off the Service. You agree that you will not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money to other members.

You are solely responsible for your interactions with other users. you understand that Merkava does not conduct criminal background checks on its users or otherwise inquire into the background of its users. Merkava makes no representations or warranties as to the conduct or compatibility of users
